Real Estate Agency - Misleading Representations

The Competition Bureau received a complaint in May 2005 alleging that an advertisement for a real estate agency was potentially misleading. Specifically, the ad contained information on exclusive listings, with statements giving the impression that an agent was excluded from dealing on behalf of their client. Such statements may not be true in all situations.

A Bureau examination conducted under the deceptive marketing practices provisions of the Competition Act, section 74.01, revealed that the advertisement in question could have raised concerns under the Act.

As a result of Bureau contact, the company agreed in writing to refrain from similar advertising in the future.

The issue was resolved in June 2005.
