The Competition Bureau received a complaint in October 2006 alleging that flower growing kits imported from the U.S. did not comply with the labelling requirements of the Consumer Packaging and Labelling Act. The flower growing kits consisted of a flower bulb, a small vase or pot, and a growing medium.
An examination conducted by the Bureau revealed that the packaging was not labelled with adequate dealer identification, nor did the packages display a proper common name for the products. Further, the packages displayed a misleading country of origin claim as the bulbs in these kits did not all originate from the stated country of origin.
As a result of the Bureau's examination, the company agreed to resolve the matter by attaching a sticker over the country of origin claim. The sticker included a proper common name for the product, the name and full postal address of the dealer preceded by the words "Imported by", and a list of the kit’s contents. The company additionally ensured that future shipments would be labelled with the required information.
This matter was resolved in October 2006.
