OTTAWA, April 28, 2008 — The Competition Bureau is seeking public comments on its
draft Information Bulletin on Sentencing and Leniency Recommendations in Cartel Cases.
The Bulletin outlines the factors the Bureau considers when making sentencing recommendations to the Director of Public Prosecutions and the process for seeking a recommendation for a lenient sentence.
The Leniency Program supports the effective and efficient enforcement of the Competition Act and complements the Bureau's Immunity Program. The Bureau recommends immunity from prosecution for the first person to approach the Bureau who admits involvement in an offence and meets Program criteria. A recommendation for lenient treatment may be available for a person who cooperates with the Bureau’s investigation and admits involvement, but is not first in or does not meet the Immunity Program’s criteria. Whether or not the Bureau recommends lenient treatment in sentencing is based on the timeliness and value of the person's cooperation.
Interested parties are asked to mail, fax or e-mail their comments no later than Friday, July 25th, 2008, to:
Erica Schumacher, Competition Bureau, 50 Victoria Street, Gatineau, Québec, K1A 0C9; fax: 819-997-3835;
e-mail: schumacher.erica@cb-bc.gc.ca.
Submissions will be posted on the Bureau Web site unless it is specifically requested that they be kept confidential.
